Terms of Service

These Terms of Service ("Terms") govern your use of Thailand QR Order ("ThaiQROrder", "we", "our"), including our website at https://www.thaiqrorder.com/en, the business dashboard at business.thaiqrorder.com, and the customer-facing menu pages reached through QR codes generated by the service. By using the service, you agree to these Terms.

1. The service

ThaiQROrder provides software that lets a restaurant, street food vendor, or small business ("Business") generate per-table QR codes, publish a digital menu, and receive orders from their customers. We are a software provider. We do not prepare food, handle deliveries, or process end-customer payments.

2. Accounts

A Business account is created by providing a phone number and receiving a one-time code. You are responsible for keeping access to your phone number secure, for the accuracy of the information you upload (store name, menu, prices, hours), and for the activity that happens under your account. We may suspend or terminate accounts that violate these Terms or applicable law.

3. Free trial and subscription

New Businesses receive a free trial period of three (3) months with all features unlocked. After the trial, continued use of the service requires a paid subscription. Current monthly plans are listed on our pricing section. Fees are quoted in Thai Baht (THB) and are exclusive of applicable taxes. We may change pricing with at least 30 days' notice.

4. Commissions

ThaiQROrder charges 0% commission on customer orders. The full order amount goes directly to the Business. Our revenue comes only from the monthly subscription fee after the trial period.

5. Payments between customer and business

Payments for food orders are settled directly between the customer and the Business (for example, via PromptPay QR, cash on delivery, or in-store payment). ThaiQROrder does not act as a payment processor, merchant of record, or escrow for these transactions. We are not responsible for refunds, chargebacks, or disputes between a customer and a Business.

6. Acceptable use

You agree not to:

  • Use the service to list or sell illegal items
  • Upload menu content that infringes third-party intellectual property
  • Harass, defraud, or spam customers
  • Attempt to break, probe, or overload the service
  • Resell, sublicense, or white-label the service without our written agreement

7. Content ownership

You own the menu content, images, store information, and other materials you upload ("Your Content"). You grant ThaiQROrder a non-exclusive, worldwide, royalty-free licence to host, display, and process Your Content solely for the purpose of operating the service. The ThaiQROrder software, design, and trademarks remain our property.

8. Service availability

We aim for 99.9% uptime but do not guarantee uninterrupted availability. Scheduled maintenance, force majeure events, and upstream provider issues may affect the service. We are not liable for business losses arising from temporary unavailability.

9. Data and privacy

Our handling of personal data is described in the Privacy Policy. By using the service, you agree to the collection and use of information as described there. When operating as a Business, you are responsible for informing your customers how you use their data in accordance with applicable Thai law (including the Personal Data Protection Act, PDPA).

10. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your specific requirements or be error-free.

11. Limitation of liability

To the maximum extent permitted by law, ThaiQROrder's total liability to you for any claim arising out of or related to the service is limited to the amount of subscription fees you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data.

12. Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your subscription payment is unpaid. Upon termination, we will delete or disable your account and associated data in accordance with our retention policy in the Privacy Policy.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced through the service or by email where applicable. Continued use of the service after an update constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the Kingdom of Thailand. Disputes will be resolved in the competent courts of Thailand, unless otherwise required by mandatory consumer protection law.
